Sectors in Colombia Insist on Respect for Protocols with ELN

The demand of the government of Iván Duque to Cuba to capture and turn over the negotiators of the ELN (National Liberation Army) violates international law, the principles of good faith and mutual trust, in addition to being a political and legal error, says the Colombian jurist Rodrigo Uprimny.

Governments act internationally as representatives of the State and that is why their actions internationally commit the Colombian State as a whole, remarked the specialist in Constitutional Law.

The guarantees between the parties are usual in peace negotiations, because without them no peace process would be possible, nor would any third country accept being the guarantor or seat of peace negotiations, he added.

Furthermore, Uprimny points out that beyond the legal arguments, we must take into account the political consequences of the ignorance of the protocols and that would lead to no serious State accepting in the future be a guarantor in a negotiation with Colombia.

Last night the Cuban Foreign Ministry issued a statement in which it appealed to the government of Colombia and the ELN to adopt the pertinent actions that would allow for the 'return procedure of the ELN delegation', in accordance with the letter of the protocol established in case of rupture of the peace dialogue.

'Cuba has honored the duties that correspond to it as Guarantor and Alternative Headquarters of the Peace Dialogues between the Colombian Government and the ELN, at the request of both,' the statement said.

The Island government reiterated that 'Cuba has never allowed or allowed its territory to be used for the organization of terrorist acts against any State.'

He also reaffirmed the historic position of Cuba against terrorism and against war, in defense of peace, 'with the moral of having been a victim for decades of state terrorism.'

To the call of the academics of respect to the protocols agreed with the ELN and the guarantor countries, the Liberal, National Unity, Radical Change, Green Alliance, Patriotic Union, Democratic Pole, Communist and Revolutionary Alternative Force have joined in Colombia of the Common.
